Terms of Service

1. Acceptance of Terms

Face Minds is a product developed and operated by BynarTek ("we", "us", "our"). By accessing and using Face Minds ("the App"), you accept and agree to be bound by these Terms of Service. If you do not agree, please do not use the App.

2. Description of Service

Face Minds provides users with tools to:

• Create and manage Face Memory categories to organize memories of individuals
• Add Face Memory profiles with personal information, events, stories, and photos
• Use face recognition technology to identify and tag individuals in photos
• Use AI-powered prompts to capture and preserve personal memories
• Import family trees from printed photos using AI parsing
• Share Face Memory categories and family trees with collaborators
• Create and manage family trees with member information
• Connect with friends and manage friend relationships within the app
• Send and receive real-time messages in direct and group conversations
• Participate in category events, discussions, and comments

3. User Accounts

3.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must be at least 13 years old to create an account
• You are responsible for all activities that occur under your account
• Only one active session is permitted per account — signing in on a new device will invalidate the previous session

3.2 Account Security

• Notify us immediately of any unauthorized use of your account at faceminds@bynartek.com
• We are not liable for any loss or damage arising from your failure to maintain account security
• You may not share your account credentials with others

4. User Content

4.1 Your Content

• You retain ownership of all content you upload to the App
• By uploading content, you grant us a license to use, store, process, and display your content as necessary to provide the service
• You are responsible for ensuring you have the right to upload and share all content

4.2 Content Guidelines

You agree NOT to upload content that:

• Infringes on intellectual property rights of others
• Contains illegal, harmful, or offensive material
• Violates privacy rights of others
• Contains malware, spam, or malicious code
• Misrepresents facts or contains false information
• Harasses, threatens, or intimidates other users

4.3 Content Removal

• We reserve the right to remove content that violates these terms
• We may suspend or terminate accounts that repeatedly violate these terms

4.4 User Responsibility for Third-Party Data

By using the App, you acknowledge and warrant that:

• You have obtained explicit, informed consent from every individual whose photo, personal information, or biometric data (face recognition) you upload
• For minors (under 18), you have obtained consent from their parent or legal guardian
• You have the legal right to share information about any individuals you add, whether they are family members or not
• You will NOT upload photos of individuals who have refused or withdrawn consent
• You will immediately remove any photo or information upon request from the individual depicted
• You understand that using face recognition on someone's image without their consent may violate privacy laws
• You are solely liable for any privacy violations, defamation claims, or legal actions arising from content you upload
• Face Minds is not responsible for verifying that you have obtained proper consent

5. Messaging and Social Features

5.1 Direct and Group Messaging

• The App provides real-time messaging between users who are connected as friends
• You may create and participate in group conversations
• You are responsible for the content of all messages you send
• Messages are stored on our servers and delivered to conversation participants
• You may delete your own messages; deleted messages are marked as deleted and the text is removed

5.2 Friend Connections

• You may send and receive friend requests to connect with other users
• You control your friend list and may remove connections at any time
• Messaging is only available between users who are connected as friends

5.3 Group Chats

• Group administrators may add members, change the group name and photo, and remove members
• Group members may leave a group at any time
• Group administrators are responsible for ensuring group content complies with these terms

5.4 Messaging Conduct

• You agree not to send spam, unsolicited messages, or abusive content to other users
• You agree not to use messaging features to harass, threaten, or intimidate other users
• Violations may result in account suspension or termination

6. Subscription and Payments

6.1 Subscription Plans

• The App offers Free, Memories, and Archive subscription tiers
• Features and limitations vary by subscription tier
• Pricing is subject to change with advance notice

6.2 Free Tier

• Limited number of family trees, categories, memories, and face recognitions per month
• Includes advertisements served by Google AdMob
• Ad-supported experience with personalized or non-personalized ads

6.3 Memories and Archive Tiers

• Higher limits or unlimited access to features
• Completely ad-free experience
• No data sharing with advertising partners
• Additional features as described in the app

6.4 Payment Terms

• Subscriptions are billed monthly or annually through App Store (iOS) or Google Play (Android)
• Payment processing is handled securely by RevenueCat
• Subscriptions auto-renew unless canceled before the renewal date
• Refunds are subject to App Store or Google Play refund policies

6.5 Cancellation

• Cancel your subscription at any time through App Store or Google Play subscription settings
• Cancellation takes effect at the end of the current billing period
• After cancellation, your account reverts to the Free tier
• No refunds for partial subscription periods

7. Face Recognition Technology

7.1 How It Works

Face recognition is used to identify individuals in photos you upload. When you add a face to a profile, a mathematical representation (embedding) is computed by Amazon Web Services (AWS) Lambda and stored on our self-hosted infrastructure. This embedding is used to match faces in subsequent photos. See our Privacy Policy for full technical details.

7.2 Biometric Consent

• Explicit biometric consent is required before any face data is collected or processed
• You may withdraw consent and delete all face data at any time via app settings
• Withdrawal of consent stops future processing but does not automatically restore already-processed data unless you also request deletion

7.3 Accuracy and Limitations

• Face recognition is not 100% accurate and results should be verified by users
• We are not responsible for incorrect identifications or their consequences
• Users are responsible for reviewing and correcting recognition results

7.4 AI Services for Face Processing

Face embedding computation is performed by AWS Lambda. Prompt generation and family tree photo import use Claude AI by Anthropic. You will be informed before your data is sent to these services. See our Privacy Policy for details on what data is sent and how it is handled.

8. Sharing and Collaboration

8.1 Shared Family Trees and Categories

• You can share family trees and Face Memory categories with other users
• Shared users have access based on permissions you grant (view, comment, edit)
• You are responsible for managing sharing permissions
• You are responsible for ensuring shared content complies with privacy obligations

8.2 Collaborative Editing

• Multiple users can contribute to shared content
• Each contributor is responsible for the accuracy and legality of information they add
• Disputes between collaborators must be resolved among users

9. Intellectual Property

9.1 App Ownership

• Face Minds is a trademark of BynarTek. All rights reserved.
• The App, including its design, code, and functionality, is owned by BynarTek
• You may not copy, modify, distribute, or reverse engineer the App without permission

9.2 User Content Rights

• You retain ownership of your uploaded content
• You grant us a non-exclusive, worldwide license to use your content solely to operate and provide the service
• This license ends when you delete content or your account

10. Prohibited Activities

You agree NOT to:

• Reverse engineer or attempt to extract source code from the App
• Use automated systems, bots, or scrapers to access the App
• Interfere with the proper functioning of the App or its servers
• Attempt to gain unauthorized access to systems or other user accounts
• Use the App for any illegal purpose
• Impersonate others or misrepresent your affiliation
• Collect or store personal data of other users without their consent
• Upload content that violates intellectual property, privacy, or any applicable law
• Use ad-blocking software or methods to avoid viewing advertisements in the free tier
• Use face recognition to track, monitor, or profile individuals without their knowledge and consent
• Attempt to circumvent biometric consent requirements

11. Privacy and Data

Your use of the App is governed by our Privacy Policy, which is incorporated by reference into these Terms.

11.1 Advertising (Free Tier)

• Free tier users will see advertisements served by Google AdMob
• AdMob may collect device identifiers and advertising data
• You can opt-out of personalized ads through device settings
• Memories and Archive subscribers enjoy an ad-free experience

11.2 Third-Party Services

• RevenueCat — subscription management
• Google AdMob — advertisements (free tier only)
• AWS Lambda — face embedding computation
• Anthropic (Claude AI) — AI prompts and family tree photo import
• Firebase (Google) — authentication and push notifications

Each service has its own terms of service and privacy policy. By using the App, you agree to comply with the applicable terms of these services.

12. Disclaimers

12.1 Service Availability

• The App is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• We may suspend service for maintenance, updates, or circumstances beyond our control

12.2 Accuracy of Information

• We do not verify the accuracy of user-provided information
• Family tree and Face Memory data is provided by users and may contain errors
• Face recognition results are not guaranteed to be accurate
• You are responsible for verifying information accuracy

12.3 No Professional Advice

The App is for informational and organizational purposes only. We do not provide legal, genealogical, medical, or professional advice. Consult appropriate professionals for specific advice.

13. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months
• We are not responsible for loss of data, content, or revenue, though we make reasonable efforts to prevent such losses
• We are not responsible for actions of other users, including content they post or messages they send

14. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these terms
• Your violation of the rights of others, including privacy rights
• Content you upload, share, or transmit through the App
• Your use of face recognition on individuals without proper consent

15. Modifications to Service

We reserve the right to modify or discontinue features, update these Terms with notice, change subscription pricing with advance notice, and implement new features or restrictions.

16. Termination

16.1 By You

• You may delete your account at any time through app settings
• Deletion is permanent and cannot be reversed
• Some data may be retained as required by law (up to 90 days)

16.2 By Us

We may suspend or terminate your account if you violate these Terms, your account remains inactive for an extended period, we are required to do so by law, or we discontinue the service.

16.3 Effect of Termination

• You lose access to all content and data
• Outstanding payment obligations remain
• Provisions that should survive termination (indemnification, limitation of liability, dispute resolution) continue to apply

17. Dispute Resolution

17.1 Governing Law

These terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Vietnam.

17.2 Arbitration

Disputes will be resolved through binding arbitration, except where prohibited by law or where the claim involves a court of competent jurisdiction.

17.3 Class Action Waiver

You agree to resolve disputes individually, not as part of a class action.

18. General Provisions

• Entire Agreement: These terms, together with the Privacy Policy, constitute the entire agreement between you and BynarTek.
• Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
• No Waiver: Our failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these terms without our consent. We may assign our rights and obligations.
