1. Acceptance of Terms

Face Minds is a product developed and operated by BynarTek ("we", "us", "our"). By accessing and using Face Minds ("the App"), you accept and agree to be bound by the terms of this agreement. If you do not agree, please do not use the App.

2. Description of Service

Face Minds provides users with tools to:

• Create and manage Face Memory categories to organize memories of individuals
• Add Face Memory profiles with personal information, events, prompt-guided life stories, and photos
• Use face recognition technology to identify and tag individuals in photos
• Use AI-powered prompts to capture and preserve personal memories and stories
• Share Face Memory categories with collaborators
• Create and manage family trees, add and organize family member information
• Upload and manage photos and share family trees with other users

3. User Accounts

• You must provide accurate and complete information when creating an account
• You must be at least 13 years old to create an account
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. User Content

4.1 Your Content

• You retain ownership of all content you upload to the App
• By uploading content, you grant us a license to use, store, and display your content as necessary to provide the service
• You are responsible for ensuring you have the right to upload and share all content

4.2 Content Guidelines

You agree NOT to upload content that infringes intellectual property rights, contains illegal or harmful material, violates privacy rights of others, contains malware, or misrepresents facts.

4.3 Content Removal

• We reserve the right to remove content that violates these terms
• We may suspend or terminate accounts that repeatedly violate these terms

4.4 User Responsibility for Third-Party Data

By using the App, you acknowledge, agree, and warrant that:

• You have obtained explicit, informed consent from every individual whose photo, personal information, or biometric data you upload
• For minors (under 18), you have obtained consent from their parent or legal guardian
• You have the legal right and authority to share information about any individuals you add
• You will NOT upload photos of individuals who have refused or withdrawn their consent
• You will immediately remove any photo or information upon request from the individual depicted
• You are solely liable for any privacy violations, defamation claims, or legal actions arising from content you upload
• Face Minds is not responsible for verifying that you have obtained proper consent

5. Subscription and Payments

5.1 Subscription Plans

The App offers Free, Memories, and Archive subscription tiers. Features and limitations vary by tier. Pricing is subject to change with notice.

5.2 Free Tier

• Limited number of family trees and face recognition usage per month
• Includes advertisements served by Google AdMob

5.3 Memories and Archive Tiers

• Higher limits or unlimited access to features
• Completely ad-free experience with no data sharing with advertising partners
• Priority customer support

5.4 Payment Terms

• Subscriptions are billed monthly or annually via App Store (iOS) or Google Play (Android) through RevenueCat
• Subscriptions auto-renew unless canceled before the renewal date
• Refunds are subject to App Store or Google Play refund policies

5.5 Cancellation

• You may cancel your subscription at any time through App Store or Google Play settings
• Cancellation takes effect at the end of the current billing period
• After cancellation, your account reverts to the Free tier — no refunds for partial periods

6. Face Recognition Technology

• Face recognition is used to help identify family members and face memory profiles in photos
• Facial data is processed and stored securely — you can disable face recognition at any time
• Face recognition is not 100% accurate — we are not responsible for incorrect identifications
• Facial recognition data is used only for the purposes described and is not shared with third parties without consent

7. Sharing and Collaboration

• You can share family trees and memory categories with other users based on permissions you grant
• You are responsible for managing sharing permissions and the accuracy of information you add
• Disputes between collaborators must be resolved among users

8. Intellectual Property

• The App, including its design, code, and functionality, is owned by us
• You retain ownership of your uploaded content
• You grant us a license to operate and provide the service

9. Prohibited Activities

You agree NOT to:

• Reverse engineer or attempt to extract source code from the App
• Use automated systems to access the App (bots, scrapers, etc.)
• Interfere with the proper functioning of the App
• Attempt to gain unauthorized access to systems or user accounts
• Use the App for any illegal purpose or impersonate others
• Collect or store personal data of other users without consent
• Attempt to block, remove, or circumvent advertisements in the free tier

10. Privacy and Advertising

Your use of the App is also governed by our Privacy Policy.

• Free tier users will see advertisements served by Google AdMob
• Memories and Archive subscribers enjoy an ad-free experience

11. Disclaimers

• The App is provided "as is" and "as available" — we do not guarantee uninterrupted or error-free service
• We do not verify the accuracy of user-provided information
• The App is for informational and organizational purposes only

12. Limitation of Liability

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the service in the past 12 months

13. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from your use of the App, your violation of these terms, or content you upload or share.

14. Modifications to Service

We reserve the right to modify or discontinue features, update these Terms, or change subscription pricing with advance notice.

15. Termination

• You may delete your account at any time — deletion is permanent and cannot be reversed
• We may suspend or terminate your account for violations of these Terms, extended inactivity, or legal requirements

16. Dispute Resolution

• These terms are governed by the laws of the Socialist Republic of Vietnam. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Vietnam.
• You agree to resolve disputes individually, not as part of a class action

17. General Provisions

• These terms constitute the entire agreement between you and us
• If any provision is found unenforceable, the remaining provisions continue in effect
